Terms of service

Using BrandGauge means agreeing to these terms. They are written to be read, not to be survived.

01

Who you are contracting with

BrandGauge is operated by Ritmi, LLC, a Delaware limited liability company. Questions about these terms go to privacy@brandgau.ge.

02

What the measurement is

BrandGauge asks AI assistants a set of buyer questions several times and counts how often your brand is recommended in the answers. The result is a statistical estimate from a sample, reported with a 95% interval that tells you how much to trust it.

It is not a guarantee of how any assistant will answer any particular person at any particular moment. Those systems change without notice, personalise their answers, and are outside our control. We report what we observed, when we observed it.

Brand names extracted from answers are observations of what the text said, not verified statements about real companies, and matching is literal: we do not guess aliases.

03

Your account and your inputs

You are responsible for what you enter — the brand you track, the location and the questions — and for having the right to use it. Do not use the service to impersonate someone else's brand, to break the law, or to attack the service or its providers.

Access to a report is held by a session in your browser, or by a link we email you. Anyone holding a share link you create can read that report, so share it deliberately.

04

Free scans

Free scans exist so you can judge the product before paying. They run against one assistant and are limited per network and by a daily budget, so we can keep offering them. We may change or pause them at any time.

05

Subscription and billing

A subscription costs $17 per month for one tracked brand and renews every month until it is cancelled. Payment is taken by Stripe; we never see or store your card details. Prices are exclusive of any tax that applies where you are.

Anyone holding a share link to a report can pay for that report's subscription. If they do, the subscription and its billing belong to them, not to the person who created the report.

06

Cancelling and refunds

You can cancel at any time from the billing portal, or by writing to us. Cancelling stops the next renewal and access continues until the end of the period you already paid for.

If something went wrong on our side — the scans did not run, or the service was unusable — write to us within 30 days of the charge and we will refund it. Beyond that we do not refund part-used months, since the measurement work for that period has already been done and paid for at the providers.

If you are a consumer in the EU or UK, your statutory cancellation rights apply on top of this and are not reduced by it.

07

Availability

We do not promise uninterrupted service. Measurements depend on third-party AI providers; when one of them fails, coverage drops and a result may be marked incomplete rather than published. Provider failures are never counted against your brand.

08

Ownership

Your inputs and the reports produced for you are yours. The software, the interface and the measurement method are ours. You may share and republish your own reports freely.

09

Liability

Decisions you take based on a report are yours. To the extent the law allows, our total liability for any claim is limited to what you paid us in the twelve months before it arose, and we are not liable for lost profit or lost business. Nothing here limits liability that cannot legally be limited.

10

Ending an account

You can ask us to delete your account at any time and we will act within 30 days. We may suspend an account that abuses the service, tries to break it, or fails to pay.

11

Changes and governing law

If we change these terms materially we will update the date above and, where we have your address, tell you by email. Continuing to use the service after that means accepting the change.

These terms are governed by the laws of the State of Delaware, United States.

How we handle your data is described separately in the privacy policy.
